For the Free One-Month Web Development Service

By signing up for or utilizing the Free One-Month Web Development Service provided by Boost Your Inn Marketing (“Agency”), you (“Client”) agree to the following Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use our service.

1. Definitions

  • Service: The free one-month web development service offered by the Agency.
  • Free Trial Period: A trial lasting thirty (30) consecutive days commencing from the effective start date of the Service.
  • Paid Subscription: The transition of the Service into a paid arrangement at a monthly fee of RM150 if not cancelled during the Free Trial Period.
  • Agreement: These Terms and Conditions, which form the entire agreement between the Client and the Agency regarding the Service.

2. Eligibility

  • The Service is available only to clients who register through the Agency’s designated sign-up process.
  • By registering, the Client confirms that all information provided is accurate and agrees to timely updates if any details change.

3. Service Description

  • Scope of Services
    • Website Design and Development:
      • The Service Provider shall design and develop an SEO-friendly website tailored to the Client’s specifications and branding requirements. This includes, but is not limited to, creating a responsive layout that functions across various devices.
    • Content and SEO Optimization:
      • The Service Provider will optimize each webpage to enhance search engine visibility. This includes optimizing title tags and meta descriptions with relevant keywords, using header tags strategically to improve content readability and hierarchy, and ensuring that each page features unique and descriptive title tags.
    • Security Features:
      • The Service Provider shall ensure the website is certified with SSL, providing comprehensive guidance and support to verify SSL certification through various methods, including URL inspection, browser indicators, and online SSL checker tools.
    • Integration and Functionality:
      • The scope includes integrating essential functionalities such as a real-time booking form. The website will be tested across devices to ensure seamless integration and functionality.
    • Client Collaboration and Feedback:
      • The Service Provider commits to regular communication with the Client to incorporate feedback into the design and development process.
      • This includes scheduled reviews and revisions, ensuring that the final deliverable aligns with the Client’s strategic objectives and aesthetic preferences.
    • Project Timeline and Delivery:
      • Project milestones will be established in coordination with the Client, adhering to agreed timelines to deliver components of the project sequentially, culminating in the final website launch.
  • Limitations: The free Service is offered “as is” for demonstration purposes. Any additional requirements or modifications beyond the outlined scope may incur extra charges if initiated during or after the trial.

4. Free Trial Period Terms

  • Duration: The Service is free of charge for thirty (30) days, will begin immediately upon the Client submitting their Stripe payment details during the signup process. This includes the automatic calculation of the 30-day trial period.
  • Website Delivery Timeline: The Agency will endeavour to deliver the initial website setup within three (3) business days from the start of the Free Trial Period, provided all required information and content is supplied by the Client promptly. Delays in receiving necessary information may impact the delivery timeline but will not affect the trial period or subsequent subscription charges.

5. Payment Terms

  • Free Trial Period: The Client is entitled to a free trial period of 30 days (“Free Trial Period”), during which no fees will be charged.
  • Subscription Activation: Upon submission of payment details via Stripe, the 30-day Free Trial Period commences. If no opt-out action is received during the Free Trial Period, the Service will automatically convert to a paid subscription at the end of the trial.
  • Standard Monthly Subscription: After the Free Trial Period, a fee of RM150 per month will be billed in advance on a month-to-month basis if the Client does not opt out.
  • Plan Alternatives The Client may choose to switch to one of the following subscription plans at any time during the Free Trial Period, that including the custom domain for the website.:
    • Six-Month Contract: RM135 per month, billed monthly in advance for a six-month commitment.
    • Twelve-Month Contract: RM120 per month, billed monthly in advance for a twelve-month commitment.
  • Opt-Out Process: The Client may cancel the Service at any time during the Free Trial Period without incurring any subscription fee by:
    • Clicking the opt-out link provided in the courtesy email sent at trial commencement, or
    • Contacting us directly at support@boostyourinn.com.
  • Billing and Payment
    • Payment will be processed using the submitted Stripe payment details.
    • The first subscription fee (or the relevant plan rate) will be automatically charged at the conclusion of the 30-day Free Trial Period.
    • Subsequent subscription fees will be billed in advance on a monthly basis.
    • Payments are due on the first day of each billing cycle. Failure to process payment may result in suspension of the Service until the outstanding amount is paid.
  • Automatic Renewal and Modifications
    • The subscription automatically renews on a month-to-month basis (or per the selected contractual duration) unless the Client opts out or switches to a different plan as described above.
    • The Agency reserves the right to modify these Payment Terms upon prior notice to the Client. Any changes will apply to future billing cycles, and continued use of the Service constitutes acceptance of the modified terms.
  • Additional Fees and Payment Disputes
    • Any additional services or customizations not covered under the standard package will incur separate charges, subject to a separate agreement.
    • The Client must raise any disputes regarding invoiced amounts within 30 days of the invoice date. Failure to do so will be taken as acceptance of the billed amounts.
  • Refund Policy
    • All payments made are non-refundable except as required by applicable law, or as mutually agreed upon in writing by both parties.
  • Taxes
    • All fees are exclusive of taxes, which the Client shall pay in accordance with applicable law.

6. Cancellation and Termination

  • Cancellation during Free Trial: The Client may cancel the Service at any time during the Free Trial Period without any fee or penalty by email link or notifying the Agency in writing to support@boostyourinn.com.
  • After Free Trial: Once the Service converts to a paid subscription, standard cancellation procedures apply as per the Agency’s cancellation policy.
  • Termination by Agency: The Agency reserves the right to terminate or suspend the Service if the Client breaches these Terms and Conditions or engages in misuse of the service.

7. Intellectual Property

  • Agency Rights: All deliverables and any related intellectual property created during the Service remain the property of the Agency until full payment in any subsequent paid arrangement is received.
  • License: During the Free Trial Period, the Client is granted a temporary license to use the deliverables for evaluation purposes only.

8. Confidentiality

  • Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the term of this Agreement. Neither party will disclose such information to any third party without prior written consent, except as required by law.

9. Limitation of Liability and Disclaimer

  • Automatic booking synchronization is not available, so manual updates are necessary.
  • Automatic payment systems and other add-on services are available only to paying clients after the trial period, so additional costs may apply. This means that when guests visit the website and send you the enquiry, but the actual payment process is handled separately.
  • Service Provided “As Is”: The Service is provided without any express or implied warranties. The Agency does not guarantee that the Service will meet all Client requirements or that it will be uninterrupted or error-free.
  • Limitation of Liability: In no event shall the Agency be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Service.

10. Modifications

  • The Agency reserves the right to modify these Terms and Conditions at any time. The Client will be notified of any material changes, and continued use of the Service constitutes acceptance of the new Terms and Conditions.

11. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of Malaysia.  Any disputes arising from or relating to this Agreement shall be resolved under the jurisdiction of the courts located in Perak.
